Liebe Leute,

tatsächlich gibt es zur Zeit wenig Aktuelles aus den besetzten Gebieten. Nur wenn ISM ihre Berichte schickt, die dann oft sehr umfangreich sind. Von New Profile kommen fast nur noch Artikel, diese sind allerdings meist sehr lesenswert.

So schreibt ein Korrespondent der Chicago Tribune einen ausführlichen Bericht über die Ausländer, der großen Mehrheit von welchen nach wie vor die Wiedereinreise nach Palästina verweigert wird, trotz der Proteste der US Regierung. Inzwischen sind mehrere 1000 Leute von der neuen Politik Israels getroffen. Ein Regierungsbeamte sagt dazu "Die Politik hat sich nicht geändert, sie wird nur konsequenter angewendet". D. h. für diese Menschen, die bisher in Palästina wohnten - unter der Erschwernis, alle 3 Monate auszureisen und ein neues Touristenvisum zu beantragen - dass sie plötzlich mit sofortiger Wirkung nicht nach Hause gelassen werden. Die Chicago Tribune erzählt von Enayeh Samara, die seit 30 Jahren mit ihrer Familie in Palästina wohnt. Der Grenzbeamte in Jordanien ließ sie einfach nicht zurück - was sie machen soll, geht ihn nichts an. Ihrem Mann, dagegen, wird keine Ausreise aus der Westbank genehmigt. Nun sitzt sie verzweifelt bei ihrer Schwester in Chicago.

Der Palästinenser/Amerikaner Nofal Nofal wurde zwar wieder ins Land gelassen, seine in Jordanien geborene palästinensische Frau mit amerikanischer Staatsangehörigkeit aber nicht. Er reiste schließlich mit den älteren Kindern in die Westbank während seine Frau mit dem 1-jährigen Jüngsten in Jordanien blieb. Inzwischen hat er drei weitere Kinder zu seiner Frau gebracht, die älteren drei bleiben bei ihm. Scheidung auf israelisch?

Laut der Zeitung liegen etwa 120 000 Anträge auf Familienzusammenführung vor seit Anfang der Intifada. Dorothy spricht von ethnischer Säuberung.

Der Großvater des Refuseniks Omri Evron hat einen beachtenswerten Artikel geschrieben, "Die Grenzen des zivilen Ungehorsams" als Replik auf einen Artikel in Haaretz über seinen Enkel. Die Zeitung hat sich allerdings geweigert, den Artikel abzudrucken. Dorothy hat ihn ins Englische übersetzt und hofft auf weite Verbreitung.

"Wie allgemein bekannt ist, verfolgt Israel jetzt eine Politik der Unterdrückung gegen das palästinensische Volk, mit der sie allmählich die PalästinenserInnen ihres Landes und Lebensunterhalts berauben, systematisch tötet oder verhaftet jeden, der es wagt, gegen diesen Prozess zu rebellieren, den Pogromen jüdischer Siedler in den besetzten Gebieten freie Hand gewährt und diese Gräuel mit Lügen bedeckt, die jedem dem im Mindesten die wahre Situation bewusst ist, transparent sind."

Er macht im Weiteren deutlich, dass die Weigerung, in einer Armee zu dienen, die ständig das Völkerrecht verletzt, geradezu eine Pflicht ist, und dass die israelische Politik deutlich zeigt, dass jede Bemühung um Frieden, aus welcher Quelle auch immer, als "nicht seriös" abgelehnt wird.

"Die Frage, die die Refuseniks an die Linke stellen ist sehr einfach: Hast du irgendeine rote Linie, irgendeine Grenze, jenseits der du dich weigerst, das Spiel einer "treuen Opposition" weiterzuspielen? Wirst du erlauben, dass deine Kinder kriminalisiert und bestialisiert werden, indem ihnen befohlen wird, ethnische Säuberung und Massenmord zu begehen durch eine faschistische, rechte Regierung? Und ist die heutige Regierung nicht nahe dran, solche Handlungen zu begehen? Wiegt die "patriotische Pflicht" schwerer als die menschliche? Ist euch nicht klar, dass eine solche kriminelle Politik tatsächlich Israel schwächt, wie wir im jüngsten Krieg gesehen haben? Verlangt eure wahre patriotische Pflicht nicht, dass ihr die Refuseniks unterstützt? Dass ihr erklärt, "soweit und keinen Schritt weiter"? Dass ihr herauskommt und warnt, dass wir unser eigenes Grab schaufeln, dass Israel in einer arabischen Region lebt und dass seine Vormacht lediglich vorübergehend ist, wie jede Vormacht der Geschichte. Solltet ihr nicht warnen, dass unser nukleares Monopol eher früher als später enden wird, und dass es uns dienen sollte, Frieden zu machen zu den besten Bedingungen die noch möglich sind, nicht dazu, diesen zu vermeiden."

Aus Haaretz von gestern:

Die israelisch Armee leugnet die Behauptung einer israelischen Menschenrechtsorganisation, dass die Erschießung zweier militante Palästinenser in der Nähe von Jenin vorige Woche eine "Hinrichtung" gewesen ist.

Die Armee ist in ein Haus gedrungen, in das zwei verletzte Widerstandskämpfer geflüchtet waren, trieb die Familie in den Hof, und erschoss die zwei jungen Männer, die unter einer Decke auf dem Boden lagen. Die Menschenrechtsorganisation B'Tselem behauptet, dass die Tatsache, dass die Soldaten die Jungen nicht sofort erschossen oder gefesselt habe, zeigt, dass sie nicht als Bedrohung aufgefasst wurden.

Die Armee behauptet, dass, wenn man weiß, dass Militante in einem Haus sind, es notwendig ist, zuerst zu schießen.

Schließlich, von Akiva Eldar, eine Auseinandersetzung mit dem Töten von Zivilisten: "Im Gegensatz zu den Arabern," sagt Verteidigungsminister Peretz, "zielen wir nicht absichtlich auf Zivilisten". Im Falle Israels stelle man eine Untersuchungskommission auf, um den 'Unfall' zu untersuchen und festzustellen, dass eine solche 'Tragödie' sich nicht wieder ereignet.

"Wurde ein Ausdruck des Bedauerns den Anführer einer palästinensischen Organisation helfen, der einen Terroristen geschickt hätte, sich neben einem Anhalterposten für Soldaten in die Luft zu sprengen, wenn dieser Schurke die Bombe stattdessen neben einer Busladung Kinder detoniert? Würde die Absicht ihn und die Vorübergehenden von der Vergeltung durch die israelische Armee verschonen?"Wenn es unseren Politikern passt, haben Intentionen mit dem Konflikt nichts zu tun. Die Dutzende Siedlungen, die entgegen dem Völkerrecht etabliert wurden, können nicht als "fehlgeleitete Bombe" gesehen werden... Außenposten auf palästinensischem Land, die mit Regierungsgeldern finanziert werden sind kein "unglücklicher Fehler."

Ein Befehl, der eine palästinensische Mutter von ihren Kindern in Israel trennt, ist nicht etwas Unvermeidliches, dass der Notwendigkeit entspringt, den Terror zu bekämpfen...

Es ist eine Schande, dass gewissenhafte Menschen in Israel und weltweit auf ihrem Wachposten eingeschlafen sind und sich daran gewöhnt haben, mit absichtlichen Ungerechtigkeiten, die zur Routine geworden sind, leben. Es ist eine Schande, dass sie nur wach werden, wenn eine Bombe sein Ziel verfehlt.

The following article, on the subject of the refusal to serve in the Israeli military by several inductees, was written in response to an article on the subject by Yossi Sarid which appeared in Haaretz on Friday the 3rd of November, but was turned down by the paper. I therefore chose to publish it in this forum. The Hebrew original follows the English translation.

THE LIMITS OF CIVIL OBEDIENCE

I am the grandfather of Omri Evron, who was recently jailed in a military prison for refusing to serve in the army or even wear an IDF uniform, and about whom Yossi Sarid wrote a brilliant piece in Haaretz of Nov. 3rd. Yossi and I have fought for many years for the same causes, and I am proud to count him among my friends. But we are diametrically opposed in the matter of conscientious objection. I would like therefore to present here my arguments on the behalf of civil disobedience, which only very seldom are allowed space in the media, not even by those who support conscientious objection.

 

As is well known, Israel is now prosecuting a policy of oppression against the Palestinian people, in which it gradually dispossesses the Palestinians of their land and livelihood, systematically kills or imprisons any of them who dare to rebel against this ongoing process, allows free rein to the pogroms of the Jewish settlers in the territories, covering up these atrocities with lies transparent to anyone who is even minimally aware of the true situation.

 

The Israeli army is the chief instrument of this criminal policy, which is in blatant violation of international conventions signed by Israel and which has been denounced innumerable times by the UN, with the sole exception of the United States, which itself is today the world's foremost lawbreaker. Were it not for the special forbearance with which much of the world still bears towards us, on account of the past, we might well have been treated as Serbia was a dozen years ago. Even today, certain Israeli army officers risk arrest and indictment by the International Court of Justice in the Hague if they visit certain countries, and Ariel Sharon would have been regarded and treated as another Slobodan Milosevic.

 

An Israeli citizen who refuses to serve in an army which implements such a policy would be behaving according to the international criteria of law and morality and be entitled to the protection of the international community. Not he would be the true transgressor against the law but the country which he is the citizen of, whose army violates on a daily basis the basic moral rule the IDF is supposed to adhere to: The obligation to refuse to obey an order which bears as it were the black flag of illegality, as Justice Benyamin Halevy phrased it in the case of the Kafr Kassem massacre. And the fact that the Israeli courts cover up and whitewash this policy by legalistic casuistry and blatant excuses will eventually boomerang and undermine their standing and status.

 

The Right has no compunctions about this policy. Being survivors of the Holocaust, they argue, we are exempt from any moral duty toward others. The world, being anti=Semitic, has abandoned us to our fate, and therefore all those conventions and standards are not binding on us. Anyway, this country has been promised to us by God in his Covenant with Patriarch Abraham in the Book of Genesis and so it is also ours by right and divine law (one may comment on this that the wording of the divine promise to Abraham "I have given this land to you and to your seed" includes Ishmael, the purported ancestor of the Arabs, who was also a son of Abraham. And if one raises the issue of the Holocaust, the truth is that if it were not for the sacrifice of tens of millions of soldiers and civilians of the allied nations in the 2nd World War, very few Jews would have survived it}. But how does the atheistic Zionist Left, which does recognize our debt to the world and to its moral standards, justify its uncompromising opposition to conscientious objection?

 

At first glance, the arguments against refusing to serve of the Zionist Left seem highly persuasive: If every person decides on the morality or otherwise of state policy according to his private conscience and sets political conditions for his or her military service, the state and the army will disintegrate. The correct way to go about it is to fulfill one's civic duty while struggling in a democratic manner to change the state's policies. Moreover- one must remember that Israel, unlike any other country, lives under the threat of its neighbors' refusal to accept its very right to exist, hence it is still uniquely in danger of annihilation.

 

This is the specious myth which all of our chauvinists cling to, and deplorably the Zionist Left too. Any Arab military might is represented as an "existential threat" which should be monitored and destroyed at the first opportunity. Thus the Hizbollah with its missiles (lacking atomic weapons, jet planes, tanks and artillery) is painted as a frightening "existential menace." And we are promised that "in the next war" we shall know already how to eliminate it. That is, we are already preparing the next war, a war to restore the military caste's honor, or as they put it "to restore the IDF's deterrence capability."

 

If such a threat really exists, why don't we try to remove it by trying to achieve peace with our neighbors, as we have already done with Egypt and Jordan? But the well=known fact is that any peace feeler from the Arab side is completely ignored or rejected outright.. Why haven't we responded to the Saudi initiative? Or the peace proposal of the Arab League? Or to the Beilin=Abu Mazen compact? Or Assad's readiness to negotiate for peace? When you press, you get the sour, evasive reply that all of these proposals "weren't serious." Which all adds up to the fact that we know very well that Israel is under no threat to its existence, and that all of our recent wars (except the Yom Kippur War, which also was caused by our refusal to negotiate) were aggressive, terroristic wars caused by us.

 

In this situation, where there is not much to choose between Labor and Likud governments, the chance that Meretz will ever win power, form a government and change the country's policies is infinitely smaller than the quite realistic, frightening prospect that a fascist=racist like Lieberman will gain the premiership. His opinions are already being aired freely over the the country's electronic media, without the present prime minister voicing any objections to his views.

 

The question which the refuseniks are then posing to the Left is very simple: Do you have any red lines, any point beyond which you refuse to play any more the game of the loyal opposition? Will you permit your children to be criminalized and bestialized by being ordered to commit ethnic cleansing and mass murder by a fascist right wing government? And isn't the present government very close to undertaking such actions? Does the "patriotic duty" outweigh the human one? Don't you realize that such a criminal policy actually weakens Israel, as we have seen in the last war? Does'nt your true patriotic duty demand that you back the refuseniks? That you declare : "thus far and not a step further"? That you come out and warn that we are digging our own grave, that Israel lives in an Arab region and that its power preponderance is purely temporary, like any power preponderance in history. Shouldn't you warn that our nuclear monopoly will end much sooner than later, and that it should serve us to achieve peace on the best terms still available, not in order to avoid it.

 על הציות האזרחי וגבולותיו

 

אני סבו של עומרי עברון, שנשפט למאסר בכלא צבאי בעקבות סירובו לשרת ואף ללבוש מדי צה"ל ושיוסי שריד כתב בעניינו בגליון ה-3 בנובמבר דברים יורדים חדרי בטן. יוסי ואני נאבקנו למען אותן מטרות במשך שנים רבות ואני גא למנות אותו בין מודעי, אך בעניין הסרבנות, שהוא מתנגד לה בכל תוקף, בדומה למפלגתו, אנו חלוקים קוטבית. רצוני להציג כאן את טיעוני, שלעתים רחוקות מאוד הם מקבלים ביטוי מעל הבמה הציבורית, גם לא מפי התומכים בסרבנות.

 

מדינת ישראל מנהלת היום מדיניות של דיכוי עם, של נישולו הזוחל מעל אדמתו, של הרג שיטתי בכל מיני תואנות של כל מי שמעז להרים יד נגד התעללות בלתי פוסקת זו, של מתן דרור להשתוללות המתנחלים, תוך חיפוי על מעשי הנבלה בשקרים שקופים שכל המתמצא אף במקצת בעניינים יודע היטב את כזבם.

 

צה"ל הוא המכשיר הראשי של מדיניות פושעת זו, העומדת בניגוד לאמנות בינלאומיות שהיא חתומה עליהן ושגונתה אין ספור פעמים על=ידי האו"ם, פרט לויטו המציל של ארצות-הברית, שהיא עצמה הינה כיום הפושעת הבינלאומית מספר אחת. יתכן שלולא היחסמיוחד לו זוכה ישראל אפילו היום בגלל העבר היינו מצויים עכשיו במעמדה של סרביה לפני עשרים שנה. קצינים ישראליים מסויימים מסתכנים היום במעצר ובהעמדה בפני בית הדין הבינלאומי בהאג אם ייכנסו לארצות מסויימות, ויתכן שאריאל שרון היה זוכה ביחס בו זכה סלובודן מילושביץ לולא זכר השואה.

 

כלומר, ישראלי המסרב להתגייס לצבא המבצע מדיניות כזו ינהג לפי כל אמות המידה של החוק והמוסר הבינלאומי, ויהיה זכאי להגנת הקהילייה הבינלאומית. למעשה, לא הוא העובר על החוק אלא המדינה שהוא אזרחה, שצבאה מפר יום יום את הכלל המוסרי היסודי שצה"ל אמור לשמור עליו: סירוב לפקודה שהדגל השחור של האי=חוקיות מתנוסס מעליה, כניסוחו של השופט בנימין הלוי במשפט כפר=קאסם. והעובדה שבית המשפט הישראלי מחפה על מדיניות זו בנימוקים והצדקות ליגליסטיים מפולפלים עתידה עוד לפגוע בו ובמעמדו כבומרנג.

 

לימין אין כל בעייה עם מצב זה. לנו, כניצולי השואה, מותר הכל. העולם הפקיר אותנו, כל הגויים הם שונאי ישראל ולכן אין כל האמנות הללו מחייבות אותנו. והארץ הובטחה לנו בין כה וכה על=ידי הקב"ה בברית בין הבתרים והיא שלנו בדין (בכל זאת, בהערת ביניים, מותר להזכיר כי בהבטחה האלוהית לאברהם "לך ולזרעך נתתי את הארץ הזאת" כלול גם ישמעאל, שהרי אף הוא מזרע אברהם. ובאשר לשואה, הרי לולא קרבנם של עשרות מיליונים במלחמת העולם השניה היו יהודים מעטים מאוד שורדים בעולם). אבל איך מצדיק השמאל הציוני, האתיאיסטי, המכיר בחובנו לעולם ולמוסרו, את התנגדותו הבלתי=מתפשרת לסרבנות?

 

טענתו של השמאל הציוני נראית במבט ראשון כמשכנעת מאוד: אם כל אחד יעשה דין לעצמו, אם כל אחד יקבע תנאים פוליטיים לשירותו הצבאי, יתפוררו החברה והמדינה. הדרך הנכונה היא מילוי חובתך האזרחית תוך כדי מאבק פוליטי דמוקראטי לשינוי המדינה ומדיניותה. ולא זו בלבד – עליך לזכור שישראל, בנבדל מכל מדינה אחרת, נמצאת תחת איום של אי=הסכמת הסביבה לעצם קיומה. היא נתונה עד היום בסכנת השמדה.

 

זהו המיתוס השקרי שבו נאחזים כל הלאומנים שלנו, ולמרבה הצער גם השמאל הציוני. הודות לו מציגים כל עוצמה צבאית ערבית כ"איום קיומי" שיש לארוב לו ולחסלו בהזדמנות ראשונה. כך נהפך החיזבאללה עם טיליו (שהרי אין לו מטוסי סילון, פצצות אטום, טנקים וארטילריה) ל"איום קיומי", ומבטיחים לנו ש"במלחמה הבאה" נדע כבר איך לטפל בו. היינו: כבר מכינים את המלחמה הבאה. שהרי חייבים להציל את כבוד הכת הצבאית, או בלשונה "לחדש את כושר ההרתעה של צה"ל". האופציה של שלום אינה עולה אפילו על הדעת. והרי אם אמנם נשקף לנו איום כזה, מדוע לא ננסה להגיע לשלום עם שכנינו, כפי שכבר היגענו עם מצרים וירדן? אבל כל פניה לשלום מן הצד הערבי אינה זוכה אפילו להתייחסות רשמית. וכשאתה לוחץ ושואל – מדוע לא קיבלנו את היוזמה הסעודית, מדוע לא נענינו להצעות השלום של הליגה הערבית, ומה בדבר אמנת יוסי ביילין=אבו מאזן? נענים לך בעקימת אף ש"זה לא רציני". כלומר: האמת היא שאנו יודעים היטב ששום סכנה קיומית איננה נשקפת לנו, ושכל המלחמות האחרונות (פרט למלחמת יום כיפור, שנגרמה אף היא על=ידי סירובנו לשאת ולתת) נגרמו על ידנו. הן היו בעצם מלחמות טרור ממלכתי

 

במצב כזה, שבו ממשלות העבודה גרועות כמו ממשלות הליכוד, הרי הסיכוי ש"מרץ" יזכה אי=פעם בשלטון וישנה את המצב "באורח פוליטי" הוא נמוך לאין שיעור מאשר עליית פשיסט גזעני כמו ליברמן לראשות הממשלה. השיח שלו כבר משודר ברשויות הממלכתיות בלי שראש הממשלה הנוכחי יסתייג במאום מהצהרותיו. השאלה שהסרבנים מציגים בפני השמאל היא פשוטה מאוד: האם יש לכם קווים אדומים כלשהם? האם תשלחו את בניכם להסתאב בטיהור אתני וברצח המונים ובגזל שיישלחו לבצעם על=ידי ממשלה ימנית פאשיסטית? האם אין הממשלה הנוכחית קרובה מאוד למצב זה? האם "החובה הפטריוטית" עומדת מעל הכל? והאם אתם מפנימים בכלל את העובדה שמדיניות פושעת זו מחלישה בעצם את ישראל, כפי שנתברר מהמלחמה האחרונה? האם אין החובה הפטריוטית האמיתית שלכם דורשת שתתיצבו בעד הסרבנות? שתתריעו "עד כאן"? שתזהירו שמדינת ישראל חיה סוף סוף באיזור ערבי ושעליונות העוצמה שלה היא זמנית בלבד? הרי המונופול הגרעיני שלנו הוא לזמן מוגבל בלבד, והוא צריך לשמש אותנו כדי להשיג שלום בתנאים טובים ככל האפשר, כפי הניתן עכשיו, לא להתחמק ממנו.
